CARLETON CONDOMINIUM CORPORATION No. 177
GENERAL RULES
These rules- are intended to be an amplification of existing documents such as the Declaration and the By-Law. In any case of difference of interpretation, the senior document will apply.
1. PARKING
Street parking is governed by City of Vanier By-Laws and enforced by City ByLaws Enforcement (748-3554).
1.1 VEHICLE REGISTRATION FOR EXTRA PARKING SPOTS
Residents wanting to rent an extra parking spot must apply to the Director responsible for parking (Michel Desjardins 745-1935 evenings and weekends) who will register their name on the waiting list.
The fees as of April 1994 are $30 per month, and. $35 per month for spots with plugs for car heaters. Payments is made by pre-arranged automatic debit from the renters bank account. Once a spot becomes available, the parking spot number, car make and model,. license number, owner's name, unit number and phone number, are to be included in the registration.
1.2 VISITOR PARKING
Visitor parking spaces are to be used by non-resident visitors only.
Owners and tenants are responsible to ensure that their visitors are parking in the designated visitors parking spot. Failure to abide by the foregoing parking rule will result in the vehicle being treated as a parking violation.
1.3 VISITOR PARKING: OVERNIGHT 2:00 A.M. TO 7:00 A.M.
Visitors staying overnight or between the hours of 2:00 a.m. and 7:00 a.m. MUST register their. vehicles with Carleton Parking Management, (720-5021).
Be sure to register your guest and have the make, model, and license number available. Registrations are taken twenty-four hours a day, seven days a week.
1.4 VISITOR PARKING: MORE THAN 72 HOURS
Arrangements with the Board of Directors are to be made for visitor parking over 72 hours by contacting the Director responsible for parking (Michel Desjardins 745-1935 evenings and weekends).
1.5 ILLEGAL PARKING
If someone is parked in your private parking spot, or is blocking entry to your spot, you must call City Bylaw Enforcement Office at 748-3554 to have it removed.
Vehicles are not to be parked on Les Jardins de Montfort property other than that designated as parking. Vehicles parked in unauthorized areas shall be ticketed or towed away at the vehicle owner's risk and expense, as follows:
- Any vehicle parking in a fire route will be removed.
- Any vehicle parked on a lawn, sidewalk, curb, or other common area will be ticketed or removed.
- Any vehicle parked in the wrong space, in reserved parking areas will be removed.
- Any unregistered vehicle parked overnight or between 2:00 a.m. and 7:00 a.m. in a visitor parking area will be ticketed or removed.
- Any vehicle left unattended in a loading zone for more than 30 minutes will be ticketed or removed.
- All cars must be parked within the yellow boundary lines which designate the exclusive parking area.
Trailers and boats are not permitted on Les Jardins de Montfort property except for the express purpose of loading and unloading at which time they may be parked in a visitors parking spot. Time so permitted shall be for the loading and unloading only. Violation of this rule will be treated as any other violation.
Derelict vehicles which create a problem for snow removal will be ticketed, then towed away at the owner's risk and expense.
1.6 NO MAJOR REPAIRS
No major repairs to vehicles of any type are permitted on Les Jardins de Monfort property. Major repairs include any that involve working with fluids that can damage the road surface, and/or putting the car on jacks (due to safety and liability concerns).
MAINTENANCE POLICES
CORPORATION /UNIT OWNER MAINTENANCE RESPOSIBLILITIES
Generally, the Corporation is responsible for maintenance and repairs of all common elements.
Emergency repairs are those repairs which, if not effected immediately, could result in serious damage to property or constitute imminent danger to life. Example situations are: loss of a number of roof shingles which cause immediate or likely possibility of leakage to a unit; basement flooding, exposure of bare wires, etc. These are responded to immediately.
Periodic repairs are those repairs which, if not done seasonally or when a number of small repairs are needed in the condo. They should be reported to the Property Management Company when they occur and will be logged for action as soon as possible.
Preventative Maintenance is the pre-planned servicing of an item prior to it’s reaching a stage where repair will either be much more expensive or not possible anymore.
GENERAL SUMMARY OF RESPOSIBILITIES
CORPORATION
- Common element landscaping
- Road and walks paths
- Common element fixtures and signs
- Roofs
- Balconies
- Exterior surfaces of units: i.e. windows, window caulking, front door, shed door, exterior taps, exterior foundation
OWNER
- All maintenance to owners unit as defined in the Declaration including interior walls, floors, pipes,
- Storm doors
- Any damage to common elements caused by owner/tenant.
2.3 SEASONAL MAINTENANCE
LAWNS AND GROUNDS MAINTENANCE
The Corporation is responsible for trimming of grass and hedges, shrub and tree pruning and maintenance through use of fertilizers and pesticides (limited and targeted applications).
Owners are responsible for watering and re-seeding the private use lawns, as needed.
Pet owners are responsible for "stooping and scooping" any pet droppings from the grounds.
FALL LEAVES :
The Corporation is responsible for cleaning the eavestroughing and removing fall leaves from walkways and lawns.
OUTSIDE TAPS:
Owners are responsible for turning off the inside water tap in the basement, and opening the outside water tap, before the frost arrives in late fall, to prevent problems from pipes freezing.
SNOW REMOVAL :
The Corporation is responsible for clearing the common walkways and roads. Owners are responsible for moving their vehicle so that the snow removal contractor can clear snow from the road and parking spots.
Owners are responsible for clearing snow from the path from the walkway up to their front door. Sand and salt are available from the Cabin adjacent to the 403 block.
Owners are also responsible for clearing snow off the balconies. Please note that a PLASTIC SHOVEL must be used for this purpose, and sharp objects must not be used to remove ice. This is to prevent damage to the grey plastic membrane covering the balcony floor.
2.4 CARE INSTRUCTIONS FOR BALCONY FLOOR
The grey covering on the floor of the balcony can be damaged by sharp or pointed objects, or burned (such as by a cigarette). Such tears or burns need be caulked by a specialist to avoid water damage to the balcony and joists. Put PLASTIC PAD under the legs or base of any furniture or planters to protect the balcony floor, and use a PLASTIC SHOVEL to remove snow. Please notify the Property Management company if there is any damage to this covering.
3. ARCHITECTURAL REGULATIONS
3.1. INSTALLATIONS AND CHANGES REQUIRING PRIOR APPROVAL FROM THE BOARD OF DIRECTORS
Since the installations or changes listed below have implications for repairs and maintenance of common elements, prior formal approval in writing from the Board of Directors is required. The owner should submit their request in writing, and note the specifications of the installation or change. For some alterations an amendment to the estoppel certificate is required indicating that the owner will responsible for the risks and expense of any repairs or maintenance problems resulting from the installation or change.
The following require prior approval of the Board:
a. Building Alterations: Any alternations which will change the original arrangement or structure of the house.
b. Patios: Installation of a patio (i.e.. stone, brick, concrete slabs, or wooden patio).
c. Foundation Hole Drilling (such as for central air conditioners): With the prior written consent of the Board a maximum of two holes may be drilled, each no more than four inches in diameter. They must be drilled by or under the supervision of a person competent in this type of work.
d. Natural Gas Fireplaces Natural gas fireplaces installation must meet all applicable safety standards and city bylaws. The owner will sign an agreement to the effect that any damage caused by the installation or use of the fireplace will be repaired by the Board at the expense of the owner of the unit in which the fireplace was installed. The fireplace is to be registered on title for the property. As the installation of a fireplace is an improvement to the unit, it is not covered by the Condominium's fire insurance policy. Owners are therefore advised to obtain supplementary coverage for the value of the installation.
3.2 AIR CONDITIONERS
Air conditioners must be of high quality and such standard as to minimum disturbance to neighbours. No water cooled air conditioning - systems will be permitted due to the large amount of water required and the subsequent increased water cost. Plexiglass must be used for the installation of window air conditioners when the conditioner does not fill the normally glassed area. All air conditioners must be properly and neatly installed.
3.3 ANTENNA AND LINES
Television Antenna, Radio Antenna, Satellite saucers, Cablelines or Clotheslines: Shall not be erected upon or in any manner attached to any part of the common element.
3.4 HOUSE NUMBERS, FRONT LIGHTS AND MAILBOXES
Unit owners are encouraged to display house numbers. Material used should be in good taste compatible with home design and securely affixed to your home. Owners may add brass mailboxes and front light fixtures compatible with the home design.
3.5 SIGNS
Signs offering a unit for sale or rent shall be posted on the balcony. No sign, advertisement or notice, other than the usual signs for offering a unit for sale or rent, shall be inscribed, painted, affixed or placed on any part of the common elements or on the building without the prior written consent of the Board.
3.6 STORM DOORS
The type and appearance are to be acceptable to the Board. The door will be a self-storing type, dark brown in colour, and a minimum of one and one half (1 1/2") inches.
4. LANDSCAPING RULES
The outside circumference of any flower, bush, or shrub is not to extend beyond 36" from the house or the inside facing of the fence (i.e.. flowers, bushes or shrubs are to be within three feet of the house or fence so that the lawns can be mowed properly).
Owners or tenants are not allowed to plant flowers or any vegetation around the base of any trees.
Owners or tenants are responsible for the trimming of the grass at the edge of 'the flowerbeds.
Perennial ivy or other perennial climbing flora are not allowed.
Edible vegetables may be grown in the exclusive use area but such vegetables may not exceed four (4') feet in height.
In the event of abandonment, poor husbandry practices, disease, or pest damage, the Board reserves the right to return the area to its original state at the expense of the owner.
The maintenance and replacement of patio stones placed in the exclusive use area shall be the risk and expense of the owner and shall not be assumed by the Corporation.
5. WASTE AND RECYCLING
5.1 GARBAGE BINS
Boxes and cartons: are to be broken up and flattened before putting them in the bins. No mattresses, furniture or large appliances are to be placed in the bins. No hazardous waste (paints, paint remover, solvents, etc..) is to be placed in the bins.
5.2 RECYCLING
Residents are encouraged to recoil items and materials that they no longer need.
5.3 BLUE BOXES - City of Vanier Program
Residents are encouraged to use the blue box recycling program for newspapers, glass bottles and jars, aluminum cans, and plastic soft drink bottles. Garden waste such as dead leaves and grass clippings is collected in the fall through a city recycling program.
Effective July 4, 1994 residents of Vanier can add the following two new materials to their blue boxes:
CORRUGATED CARDBOARD (cardboard boxes) (this does not include pizza boxes, cereal boxes, shoe boxes milk or juice cartons or other boxboard packages.)
Cardboard boxes are to be opened and folded before being placed in the blue box.
CATALOGUES AND MAGAZINES
(no advertising leaflets, envelopes or fine paper)
5.4 FURNITURE AND APPLIANCES
Also please do not dump furniture or old mattresses in the bins. Instead, arrange for the company delivering new furniture to take away your old furniture, or call Ottawa Neighbourhood Services (728-3737), St. Vincent de Paul (722-7166), the Salvation Army (232-1573) or Ottawa Recycling Appliance Co. (731-1417) for pick-up of used furniture or appliances. Some companies offer an appliance collection service for a fee ranging from $15 to $30: Laidlaw Waste Systems (745-6166) and Osgoode Recycling (821-3224).
5.5 HAZARDOUS WASTE - Municipal Program
Hazardous waste items such as: solvents, paints, used batteries, prescription medicines, pesticides, etc.. should be taken to the Municipal site for disposal of hazardous waste. For further information please contact the Hazardous Special Waste Line at 560-6075.
PARKING RULES
- Visitor’s parking spaces are to be used by non-resident visitors only. This is effective May 1st, 1980.
- When the use of a visitor’s parking spot is required in excess of a 72 hour period, the owner or tenant, on behalf of the visitor, must obtain permission from the Board.

- Trailers, boats, and other non-motorized vehicles are not permitted on Corporation property except for the express purpose of loading and unloading at which time they may be parked in a visitors parking spot. Time so permitted shall be for the loading and unloading only. Violation of this rule will be treated as any other violation.
- No major repairs to vehicles of any type are permitted on Corporation property.
- Vehicles are not to be parked on Corporation property, other than that designated as parking. Vehicles parked in unauthorized areas shall be towed away at the owner's or tenant's risk and expense.
- Derelict vehicles which create a problem for snow removal will be towed away at the owner's risk and expense.
- All cars must be parked within the white boundary lines which designate the exclusive parking area.
- Violations of the above rules will be dealt with at the discretion of the Board either by Ottawa police ticketing or by removal from the property at the owner's risk and expense.
COMMON ELEMENT RULES
Applications, noting specifications, for permits under these rules, where required, will be made to the Board of Directors in writing, in accordance with the following guidelines and specifications. RENTAL POLICY FOR VISITOR DESIGNATED PARKING SPACES
- Subject to the terms of the signed lease between the Corporation and the Vehicle Owner, once a space has been assigned to a unit that parking space shall become the exclusive use area of said unit until such time as the Vehicle Owner no longer wishes to rent the space.
- Allocation of parking spaces shall be at the discretion of the Board.
- Preference shall be given to those unit owners presently owning more than one vehicle.
- Preference shall be given to owners over tenants.
- A list shall be kept of those owners who do not obtain a parking space on December 1, 1980, in the event a parking space subsequently becomes vacant. Those wishing to be considered in the future should submit their request in writing to the Board so as to be placed on the list.
- This agreement is non-transferable.
- The rental fee shall be $ per month for a parking space, payable in advance. Signed leases shall be accompanied by the first month's rent and the remainder of the payments for the remainder of the fiscal year, in post-dated cheques.
- The Board reserves the right to review the fee structure and if deemed necessary, to raise said fee.
- N.S.F. or returned cheques, or non-payment by the first day of the month shall be considered as a cancellation of the agreement, in which case rule five shall come into effect.
- Assigned parking spaces shall not be used for semi or permanent storage.
- The Parking Committee shall be relieved of any responsibility regarding the patrolling of the assigned rental spaces.
- Vehicles shall be moved to facilitate snow plowing and removal.
- The Board reserves the right to cancel a rental space with just cause due to non-compliance with this policy, the lease agreement or the parking rules.
